Environmental PolicyBayou Steel Corporation and subsidiaries (the "Company") require that the Company and every employee in all operations strive to protect public health and the environment, conserve valuable resources, and prevent violations of Environmental Laws. The Company is committed to ensure that the employee, customer, and the community in which we operate are not harmed by our activities, processes, or products. The Company is also committed to the principles of pollution prevention and continual improvement related to environmental matters. Each of the Company facilities will set specific targets and objectives related to improvement in environmental performance. Progress toward these targets and objectives will be reviewed on a regular basis but in no case less than annually. The Company will comply at all times with all Environmental Laws. The term "Environmental Laws" is broadly defined as all laws, regulatory acts, promulgated guidelines and standards, and ordinances of any federal, state or local agency or authority applicable to the Company's property, operations, business, and employees. Environmental Laws include provisions regulating discharges of material into the air or contained in the ambient air, discharges into waterways or sewers and handling, storage and disposal of all other wastes. Where strict compliance with the Environmental Laws under current enforcement policies and practices of applicable authorities is not immediately possible, the Company will take necessary steps to achieve compliance as soon as practicable and within the law. Every employee has a responsibility to himself, to his fellow employee, and to the Company to work within the environmentally sound procedures established by the Company. No employee is authorized to violate, intentionally or by accident, any Environmental Law or the terms of any order, permit, or citation to which the Company is a party to or by which is bound. The misuse of or interference with equipment provided for environmental control is prohibited. For the protection of the employee and the Company, it is essential that all employees make a prompt and full disclosure to the Company of any situation which might involve an actual or potential violation of Environmental Laws. Although it is impossible to list every circumstance giving rise to possible or actual Environmental Law violations, examples of the types of activities which might involve an actual or potential violation are failure to report the release of a pollutant into the air, water, or on to the land, transporting hazardous wastes to an unpermitted facility, or discharging contaminants into natural waterways, public sewers, into the air or on to land without proper permission. To assure a clear understanding between the employee and the Company concerning this policy, each employee is required as a condition of employment to complete an Environmental Policy Audit Certificate on a periodic basis as the Company may require. The issuance and distribution of this policy is not intended to indicate something new or that there are any known or unknown Environmental Law violations, but rather to call attention to and put into writing what has been the Company's policy on all such matters since the Company's founding and the underlying understanding between the Company and its employees regarding compliance. |
